Pending Adoption of Administrative Rules - 1600.460, 1600.461 and 1600.625.
TThe proposed new Sections 1600.460 and 1600.461, and the proposed amendment to Section 1600.625 are intended to implement legislative changes to Article 15 of the Illinois Pension Code [40 ILCS 5/15] made by PA 100-587, effective June 4, 2018. The proposed amendment to Section 1600.271 implements changes to Section 15-155 of the Illinois Pension Code [40 ILCS 5/15-155] under PA 100-624, retroactively effective July 6, 2017. The proposed amendments to Section 1600.110 updates procedures for submitting FOIA requests to SURS.

Adoption of Administrative Rules - 1600.140, 1600.550 and 1600.605. (effective 02/02/17)
The proposed rulemaking seeks to amend Sections 1600.140, 1600.550 and 1600.605. This rulemaking proposes adding a SIMPLE IRA clarification to 1600.140, adds a vacation payment and disability benefit commencement section and further clarifies 1600.605 to further define what documents SURS may accept as evidence of a Consent to Issuance of QILDRO.
Adoption of Group Rules - 1600.202, 1600.203, 1600.270, 1600.275, & 1600.510 (effective 01/04/16)
The proposed rulemaking seeks to amend Sections 1600.202, 1600.203, and add a new Section 1600.275 to define statutory terms and set forth administrative procedures to implement Sections 15-139 and 15-139.5 of the Illinois Pension Code, concerning post-retirement employment and employer contributions for employing “affected annuitants.” The proposed rulemaking adds a new Section 1600.510 to provide for employer appeals to the Director of Member Services and, subsequently, to the Executive Committee. Executive Committee determinations constitute a final administrative decision that the employer may appeal to the Circuit Court of Champaign County under the Administrative Review Law (735 ILCS 5/3-101 et seq.).
Adoption of Group Rules - 1600.100, 1600.120, 1600.205 & 1600.241 (effective 02/22/12)
Sections 1600.100, 1600.205 and 1600.241 – these proposed amendments will ensure that SURS is in compliance with the Heroes Earnings Assistance and Relief Tax Act of 2008 (“HEART Act”). Section 1600.120 this proposed amendment is to redefine the number of trustees needed to establish a quorum for a Board meeting and deletes one obsolete sentence. These revisions are necessary due to the changes in the composition of the Board, as set forth in Public Act 96-006.
Adoption of Board Trustee Election Rules - 1600.700-750 (effective 06/22/11)
Prior to PA 96-6, all members of the SURS Board were appointed by the Governor. These new rules establish the procedures for holding a Trustee election. Previous emergency rules expired subsequent to the May 2009 Trustee Election. [40 ILCS 5/15-177][40 ILCS 5/15-159]
Amendments to the Disability Claims Procedure - 1600.320 (effective 06/25/10)
Revisions to the Disability Claims Procedure were needed in order to revise the disability claims review process by clarifying the necessary criteria for the award of disability benefits, establishing the role of the medical claims processor, and establishing procedures for the ongoing investigation of disability claims. Amendment to the Rules of Practice - Nature and Requirements of Formal Hearings - 1600.500 (effective 11/23/09)
Nature and Requirements of Formal Hearings rule. The amendment changes some internal organizational chart nomenclature, the structure and status of the claims panel, and the effect of panel decisions. The rule amendment also makes some process changes and clarifies the options and responsibilities of the parties. The structure and status changes to the claims panel are required for compliance with Public Act 96-0006 [40 ILCS 5/1-113.16(c)].
Amendments to the QILDRO Rules - 1600.600-665 (effective 7/1/09)
Revisions to 1600.600-1600.665, the Qualified Illinois Domestic Relations Order (QILDRO) rules, are necessary in order to incorporate changes to the Illinois Pension Code through Public Act 94-657.
