Affected SURS members will soon receive a letter and form explaining their rights and opt-out option in the “percent of annuity” insurance premium settlement (i.e., Kanerva v. Weems).
The State of Illinois offers annuitants and survivors a healthcare program called Total Retiree Advantage Illinois (TRAIL). The 2015 plan year started January 1, 2015, and will run through December 31, 2015.
State retirees and survivors will no longer be required to pay a percentage of their annuity for health insurance premiums following a ruling by the Sangamon County Circuit Court.
Effective September 1, 2014, the percentage of annuity State of Illinois retirees and survivors pay for health insurance will revert to 1% or 2%.
The state Supreme Court ruled health insurance subsidies promised to retirees are protected by the state Constitution. The lawsuit now goes back to the lower court for further litigation.
